Can nonbiological parents be awarded custody?
Non-biological parents and time sharing needs to be broken into two different circumstances. First, if you’re talking about a parent that has adopted a child they are treated identically under Florida law as a parent that is a biological parent. They have all of the same rights when it comes to time sharing. A second circumstance would be how about if we’re talking about a situation not involving either parent, such as a grandparent, an uncle, an aunt, or a great friend of the child. Well all of those non-parents, non-biological parents, have no right to insist on time sharing with the minor child unless both of the minor child’s parents have been adjudicated to be unfit parents, not being able to spend unsupervised time with the child. That is a very steep standard such as jail time keeps them away, significant drug abuse and homelessness and the list goes on and on.
